Is paying an India freelancer the same as paying an India employee?
No. A freelancer is engaged under a contractor agreement and is responsible for their own GST and income tax. An employee is on payroll and the employer (or Employer of Record) handles PF, ESIC, gratuity, TDS, and Form 16. The two are not interchangeable; mixing them up creates misclassification risk under India's 2020 Industrial Relations Code.
If the engagement looks like employment (fixed hours, your equipment, your roadmap, exclusive engagement), Indian tax authorities can reclassify it retroactively. The payer becomes liable for PF, ESIC, gratuity, and back-TDS on the full duration. Penalties compound at 12% per annum on PF dues. Our Contractor of Record layer structures the engagement to pass the substance-over-form test.
Yes. We deduct TDS at the applicable rate (1% for individuals, 10% for professionals with PAN), file the quarterly TDS return, and issue Form 16A to the freelancer. The freelancer reconciles Form 16A with Form 26AS at their annual income tax filing. You see the TDS deduction as a line item on the monthly USD invoice.
Yes. The Contractor of Record to Employer of Record conversion is a documented playbook. The contractor agreement closes, the employment contract opens, and we file the PF onboarding (UAN continuity preserved if they had prior PF history). The transition takes 5 business days and costs nothing extra.
We pay the freelancer in INR on the last working day of the month. We invoice you in USD, Net 15, on a single consolidated invoice per month. We hold the FX exposure between INR payout and USD invoice. There is no FX markup. The math reconciles to the Reserve Bank of India reference rate on invoice date.
There is no minimum. We engage freelancers for as little as one month. The $19 per contractor per month fee is pro-rated for partial months. There is no setup fee and no exit penalty.
You need a registered entity in any country (US, UK, EU, Canada, Australia, Singapore). The Master Services Agreement is between your entity and Foo Falcon Technologies Pvt Ltd (the Indian entity that runs Versatile). The freelancer agreement is between Versatile and the India freelancer. You are not a counterparty to the India contract.
